ELECTION RULES
Art. 1 - The election of social posts is provided for through a
mandate which expires after three years (art. 5 associative
statute).
Art. 2 - When the three-year mandate expires, the Board of
Directors calls new elections, notifying this by ordinary letter,
e-mail and publication on the association’s official web site.
The notification must be communicated at least 60 days before
the date of the election of the new board. It has to contain the
number of elements of the board to be elected (according to the
provisions in art. 5 of the associative statute) and the way to
vote, according to the provisions of these rules.
Art. 3 - The candidatures for the replacement of the Board,
subject to the provisions in art. 5 of the associative statute,
have to reach the office of the Terredelsud association within
and no later than 30 days before the date fixed for the
replacement of the Board (art. 2 of the associative statute). If
by this period there are no more than 100 members in the
association, then the Board of Directors is automatically
reconfirmed by choosing among the founding members, who, at the
first possible meeting of the Board, decide the social posts
through a resolution of the Board. In the event of a tie the
vote of the oldest member counts. In the event of a resignation,
death or incompatibility of a founding member to cover such a
position, a supplementary election will be held according to the
provisions established in art. 2 of these rules.
Art. 4 - The outgoing Board composes the lists of the candidates
for the social posts, communicating these to the members by
ordinary letter, e-mail and publication on the association’s
official web site within and no later than 15 days before the
date established for voting.
The members can express their vote by compiling a paper ballot,
indicating the number of new councillors to be elected (or to be
integrated) and/or through electronic vote as will be indicated
each time by the Board of Directors. The voting member will have
to vote for a number of candidates equal to those to be elected;
excess candidates will not be considered. The vote, in whatever
form it is expressed (paper and/or via computer when the latter
has legal value) will have to arrive, following the conditions
foreseen for voting, within and not over the date established by
the outgoing Board. Every other means of voting will result in a
spoiled vote.
Art. 5 - After the counting of the ballots, the outgoing President,
or in his/her absence, the oldest on the outgoing Board, having
ascertained the qualifications of the voted candidates, will
render public the results on the association’s official web site
and via e-mail within and no later than 15 days from the
counting of the votes.
Art. 6 – During the counting of the votes, at least three
scrutinizers will have to be present, one of which serving as
the President of the polling station, and these enter all the
operations and possible irregularities or spoiling of votes into
a special record.
Art. 7 - Possible contestations against the voting operations and
the counting of the votes must be expressed by those having this
right according to the provisions laid out for this in the Civil
Code. Anything not expressly provided for in these rules will
fall under the appropriate regulations of the Civil Code.
Art. 8 – These rules will have to be approved at the first session
of the Board and published on the association’s official web
site within and no later than 30 days from their resolution.
